Action in the district court for Hennepin county to recover for injuries sustained by plaintiff, a pedestrian, when struck at a street intersection in the city of Minneapolis by an auto owned by the defendant Robert A. Fredsall, driven by the defendant John Herseth. By amended complaint, negligence was also alleged as to the defendant Minneapolis Street Railway Company and one of its motormen, the defendant Lloyd A. Worthley. The case was tried before John A. Weeks, Judge, and a jury, and a verdict of $10,600 returned for plaintiff against all the defendants. From an order denying their alternative motions for judgment or a new trial, defendants Fredsall and the Minneapolis Street Railway Company and Worthley separately appealed.
